End User License Agreement & Terms of Use

This End User License Agreement ("EULA" or "Agreement") is a legal contract between you ("User," "you," or "your") and VSY Design LLC ("Company," "we," "us," or "our") for the use of LessThan3 (styled as "<3"), including all related software, applications, and services ("Software" or "Service").

By downloading, installing, accessing, or using the Software, you acknowledge that you have read, understood, and agree to be bound by all terms of this Agreement. If you do not agree to these terms, you must not use the Software and should immediately uninstall and delete all copies.

Covered Services

This EULA covers all LessThan3 services and platforms:

• Emma AI Companion
• LessThan3 Relationship Coaching Platform
• Mobile applications (iOS and Android)
• Web applications and browser-based services
• API services and integrations

Limited License

Subject to your compliance with this Agreement, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Software for your personal, non-commercial purposes.

Permitted Uses

• Access and use the Software for relationship coaching and support
• Create and maintain one personal account per user
• Receive AI-generated relationship guidance and advice
• Use communication features as intended

Prohibited Uses

You may NOT:

• Reverse engineer, decompile, or disassemble the Software
• Copy, modify, distribute, or create derivative works
• Use the Software for commercial purposes without written permission
• Attempt to gain unauthorized access to our systems or other users' accounts
• Use automated tools (bots, scrapers) to access the Service
• Share your account credentials with others
• Use the Service to transmit harmful, illegal, or inappropriate content
• Circumvent any security measures or technical limitations

Company Ownership

The Software and all related intellectual property rights are and remain the exclusive property of VSY Design LLC. This includes:

• Source code, object code, and software architecture
• Algorithms, AI models, and training data
• User interfaces, graphics, and design elements
• Trademarks, service marks, and brand names
• Documentation, help files, and instructional materials
• Database structures and compiled data

User Content

While you retain ownership of content you create (messages, personal information), you grant us:

• A worldwide, royalty-free license to use your content to provide the Service
• Right to process and analyze your data for AI training and improvement
• Permission to create anonymized, aggregated insights from user interactions

Account Security

• Maintain the confidentiality of your login credentials
• Notify us immediately of any unauthorized access
• Use strong, unique passwords for your account
• Keep your contact information current and accurate

Acceptable Use

• Provide truthful and accurate information
• Use the Service in good faith for its intended purpose
• Respect other users and maintain appropriate communication
• Comply with all applicable laws and regulations
• Report bugs, security vulnerabilities, or inappropriate content

System Requirements

• Maintain compatible devices and operating systems
• Ensure stable internet connectivity for optimal performance
• Keep your app updated to the latest version
• Use supported browsers for web-based access

Service Communications

By using LessThan3's messaging service, you consent to:

• Receive confirmation messages upon signup
• Receive recurring automated relationship guidance and informational messages
• Message frequency that varies based on your interaction with our AI coach
• Standard message and data rates that may apply

User Controls

• Delete your account at any time
• Text "STOP" to cancel messages at any time
• Text "HELP" for support information
• Email support@lessthan3.app for assistance
• Notify us before changing your phone number

No Warranty

THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

Not a Substitute for Professional Care

The Service is not a substitute for professional mental health treatment or emergency services. Our AI coach does not replace licensed therapists or mental health professionals.

AI Technology Limitations

Users acknowledge that they are interacting with artificial intelligence technology that:

• May not always provide perfect or complete responses
• Should not be relied upon for critical mental health decisions
• Cannot provide emergency intervention or crisis support
• May experience downtime, errors, or technical issues
• Continuously learns and improves, which may result in varying response quality

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VSY DESIGN LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

OUR TOTAL LIABILITY FOR ANY CLAIMS RELATED TO THE SOFTWARE SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

Exceptions

These limitations do not apply to:

• Death or personal injury caused by our negligence
• Fraud or fraudulent misrepresentation
• Any liability that cannot be excluded by law

Termination by User

You may terminate this Agreement at any time by:

• Uninstalling and deleting all copies of the Software
• Discontinuing use of all Services
• Requesting account deletion through support

Termination by Company

We may terminate or suspend your access immediately if you:

• Violate any terms of this Agreement
• Engage in prohibited or harmful activities
• Fail to pay subscription fees when due
• Pose a security risk to other users or our systems

Effect of Termination

• Your license to use the Software immediately ends
• You must cease all use and delete all copies
• We may retain certain data as required by law or for legitimate business purposes
• Surviving provisions (warranties, liability limitations) remain in effect

Some of our plans offer a 7-day free trial. By starting a trial, you:

• Agree to provide valid payment information
• Will be automatically charged when the trial ends unless cancelled
• Understand all fees are non-refundable except where required by law
• Acknowledge that subscription fees may change with 30 days notice

Auto-Renewal

Subscriptions automatically renew unless cancelled before the renewal date. You can cancel anytime through your account settings or by contacting support.

Governing Law

This Agreement is governed by the laws of the United States and the state where VSY Design LLC is incorporated, without regard to conflict of law principles.

Dispute Resolution

Any disputes arising from this Agreement will be resolved through:

• Good faith negotiation between the parties
• Binding arbitration if negotiation fails
• Courts of competent jurisdiction as a last resort

Class Action Waiver

You agree to resolve disputes individually and waive any right to participate in class action lawsuits or class-wide arbitration.

Entire Agreement

This EULA, together with our Privacy Policy and Refund Policy, constitutes the entire agreement between you and VSY Design LLC regarding the Software.

Amendments

We may update this Agreement from time to time. Material changes will be communicated via email or through the Software. Continued use after changes constitutes acceptance.

Severability

If any provision of this Agreement is found unenforceable, the remaining provisions will continue in full effect.

Force Majeure

We are not liable for delays or failures due to circumstances beyond our reasonable control, including natural disasters, government actions, or network outages.
